Podcast Sportfraude PrOFS - Dark clouds above Belgian sports: an insight into current academic work on sports fraud.

In deze eerste podcast aflevering geven PrOFS onderzoekers Louis Vandercruysse en Lucie Vanwersch een eerste zicht op hun onderzoeksresultaten van het afgelopen jaar. De verschillende topics bespreken ze via een dubbelinterview met Mevr. Christine Casteels. De inhoud van de podcast is opgedeeld in onderstaande hoofdstukken.
Hoofdstuk 1: Inleiding (0'00" - 3'31")
In dit eerste hoofdstuk stellen Lucie en Louis, de onderzoekers, zichzelf voor, en het grootschalige project waar we bij betrokken zijn genaamd PrOFS (Preventie van Fraude in de Sport). Vervolgens stellen ze ook de gast van hun podcast voor, Christine Casteels, strategisch adviseur van het sportfraudeteam van de Federale Politie. Ten slotte geven ze een overzicht van de verschillende onderwerpen die in de podcast aan bod komen.
Hoofdstuk 2: Operatie Schone Handen (3'31" - 9'14")
In hoofdstuk 2 gaan Louis en Lucie kort in op de context van het grootschalige fraudeschandaal dat in oktober 2018 aan het licht kwam in het Belgische voetbal. Louis geeft een overzicht van de huidige stand van zaken van de tuchtrechtelijke en strafrechtelijke procedures in deze zaak. Lucie geeft inzicht in een recent onderzoek dat samen met 'Het Nieuwsblad' werd uitgevoerd en waarbij fans en niet-fans van voetbal werden ondervraagd over de impact die dit schandaal had op hun vertrouwen in de sport.
Hoofdstuk 3: De Macolin Conventie en internationale en nationale samenwerking (9'14" - 16'19")
Louis gaat in op de Macolin Conventie, de eerste internationale conventie die zich specifiek bezighoudt met wedstrijdvervalsing. De conventie vormde een aanzet tot meer grensoverschrijdende samenwerking en samenwerking tussen publieke en private actoren in de strijd tegen wedstrijdvervalsing. Het gaf met name de aanzet tot de oprichting van zogenaamde nationale platforms in heel Europa en daarbuiten, waaronder België.
Hoofdstuk 4: Activiteiten van het Belgisch Nationaal Platform (16'19" - 19'55")
Lucie bespreekt de activiteiten van het Belgisch nationaal platform en werpt een licht op de werking en het gebrek daaraan van controlesystemen die de sport moeten beschermen tegen (gokgerelateerde) matchfixing en georganiseerde criminele groepen.
Hoofdstuk 5: De (gebrekkige) toepassing van het Belgische strafrecht op specifieke gevallen van wedstrijdvervalsing (19'55" - 25'10")
Louis gaat dieper in op het Belgisch strafrecht en de (on)toepasbaarheid ervan op individuele gevallen van match-fixing. In het bijzonder worden de Belgische private omkopingsbepaling (art. 504bis & ter BCC) en de achterpoortjes die hiermee gepaard gaan besproken.
Hoofdstuk 6: Het transfersysteem in het voetbal (25'10" - 27'22")
Louis legt uit waarom de transfermarkt in het voetbal een belangrijk onderwerp is om te behandelen wanneer we kijken naar fraude in de sport, en hoe hij dit zal doen in zijn toekomstig onderzoek.
Hoofdstuk 7: Toekomstig onderzoek en conclusie (27'22" - 30'00")
In dit laatste hoofdstuk legt Lucie uit hoe ze de gevolgen van fraude in de sport zal bestuderen aan de hand van een case-based design. Daarna sluiten we de podcast af door kort in te gaan op het valorisatiepotentieel van ons onderzoek.
Chapter 1: Introduction (0’00” – 3’31”)
In this first chapter, Lucie and Louis, the researchers, introduce themselves, and the large-scale project they are involved in called PrOFS (Prevention of Fraud in Sports). Then, they also introduce the guest of their podcast, Christine Casteels, strategic advisor for the sports fraud team of the Federal Police. Lastly, we provide an overview of the different topics addressed in the podcast.
Chapter 2: Operation Clean Hands (3’31” – 9’14”)
In chapter 2, Lucie and Louis briefly address the context of the large-scale fraud scandal that came to light in October 2018 in Belgian football. Louis gives an overview of the current state of the disciplinary and criminal procedures in this case. Lucie provides insights into a recent study conducted with ‘Het Nieuwsblad’ inquiring fans and non-fans of football about the impact this scandal had on their trust in the sport.
Chapter 3: Macolin Convention and international and national cooperation (9’14” – 16’19”)
Louis addresses the Macolin Convention, which is the first international convention to specifically deal with match-fixing. The Convention formed an impetus for more cross-border cooperation and cooperation between public and private actors in the fight against match-fixing. In particular, it sparked the creation throughout Europe and beyond of so-called national platforms, including Belgium.
Chapter 4: Activities of the Belgian National Platform (16’19” – 19’55”)
Lucie discusses the activities of the Belgian national platform and sheds a light on the functioning and lack thereof of monitoring systems which aim to protect sports against (betting-related) match-fixing and organized criminal groups.
Chapter 5: The (lack of) application of Belgian criminal law on specific cases of match-fixing (19’55” – 25’10”)
Louis delves into the topic of Belgian criminal law and its (in)applicability on individual cases of match-fixing. In particular, the Belgian private bribery provision (art. 504bis & ter BCC) and the loopholes that come with it are discussed.
Chapter 6: Football transfer system (25’10” – 27’22”)
Louis explains why the transfer market in football is an important topic to address when looking at fraud in sports, and how he will do so in his future research.
Chapter 7: Future research and conclusion (27’22” – 30’00”)
In this last section, Lucie explains how she will study the consequences of fraud in sports using a case-based design. We then conclude the podcast by addressing briefly the valorisation potential of our research.
